Regional Comprehensive Economic Partnership (RCEP): India’s concerns

The Regional Comprehensive Economic Partnership is slated for conclusion by November 2019. However, from India’s perspective, several issues like Investor-State Dispute Settlement, Rules of Origin and the proposed Auto-Trigger and Snapback Safeguard Mechanism under the trade remedies, remain unresolved. The author of the article in this 100th issue of International Trade Amicus points out that RCEP members appear to have had an adverse experience with ISDS with majority of cases against India, Japan and Korea and hence there is substantial speculation that ISDS clause would be dropped for now and will be introduced after some time. The author believes that India’s ability to safeguard against the same remains under question. On Rules of Origin, the author raises a question as to whether non-acceptance of stricter ROO would reopen market access negotiations.
