This January 2025 issue is broadly divided in two parts – Enforcement and Merger control. Part I relating to enforcement summarizes various important decisions of the Competition Commission of India (CCI) and that of the NCLAT, while Part II, discussing the developments relating to Merger Control, covers few decisions of the CCI and one recent decision of the Supreme Court of India.
The SC has held that resolution plans involving combinations need prior approval of the CCI before being considered by the Committee of Creditors.
